Small, But Important Fun on the Fourth Carnival Development

WILMINGTON, MA — You may have missed it, but in this week’s Wilmington Town Crier, there is a brief legal notice, on Page 11, submitted by Wilmington Planning Board Chair Michael Sorrentino that relates to the future of the Fun on the Fourth’s carnival.  The notice reads:

The Planning Board will hold a Public hearing on March 21, 2016 at 7:30 p.m. in Room 9 of Town Hall, 121 Glen  Road, Wilmington, MA in accordance with M.G.L. Chapter 40A Section 16 to consider granting consent to the Wilmington Zoning Board of Appeals to hear a repetitive petition for a Special Permit for a Carnival (Section 4.1.9 of the Wilmington Zoning Bylaw) operating Thursday, June 30, 2016 through Sunday, July 3, 2016 and to be located at the Swain Parking Lot, Assessor’s Map 66 Parcel 1.

A copy of the petition is on file at the Planning & Conservation Department and may be viewed during the hours of 8:30 a.m. and 4:30 p.m. Monday through Friday.

With the publication of the notice above, it appears the Town is, at the very least, keeping its options open in case it is able to meet Board of Appeal member Dan Veerman’s demand of establishing a $20,000 fund to cover third-party damage done to direct abutters’ properties and cover any increase in direct abutters’ home insurance rates.

At the most recent Board of Selectmen meeting, Town Manager Jeff Hull said he would explore the creation of such a fund as long as the town or Fourth of July Committee would not have to assume any liability from potential aggrieved homeowners.

Based on my reading of Mass. General Law Chapter 40A, Section 16, four of the five Planning Board members must vote in favor of granting the Board of Appeals permission to consider the permit request again.
