WILMINGTON, MA — The Wilmington Board of Health will be holding a public hearing at its meeting on Tuesday, November 7 at 5:30pm in Town Hall (Room 9) to discuss a proposed amendment to its regulations.
The amendment specifically deals with marijuana use — an issue that is not explicitly addressed in the Board of Health’s current regulations.
The following language is proposed to be added to Section 8 (“Smoking and Tobacco Products”) of the town’s health regulations:
“Smoking marijuana is prohibited wherever smoking cigarettes is prohibited.”
8.0 Definitions: Smoking shall mean having in possession or control any lighted cigar, cigarette, e-cigarette, other lighted tobacco substance in any form, any nicotine delivery product or device or marijuana (as defined below).
“Marijuana” or “Marihuana,” all parts of any plant of the genus Cannabis, not expected below and whether growing or not; the seed thereof; and resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin including tetryhydrocannibnol as defined in section 1 of chapter 94C of the General Laws; not including below:
(1) The mature stalks of the plant, fiber produced from the stalks, oil, or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, fiber, oil, or cake made from the seeds of the planet or the sterilized seed of the plant that is incapable of germination;
(2) Hemp; or
(3) The weight of any other ingredient combined with marijuana to prepare topical or oral administration, food, drink or other products.
The Board of Health will also discuss the town’s upcoming Special Town Meeting; upcoming town flu clinics; and septic system installations, plus review food inspection reports.
