LETTER TO THE EDITOR: Town Map Is ‘Invalid,’ Petitioner Questions Town Meeting Vote

Dear Editor,

As Lead Petitioner of Article 52 [at the 2017 Annual Town Meeting], we thank all of the voters, taxpayers and supporters of Article 52.

The Town “Official Map,” pursuant to MGL chapter 41 section 81 E, must be updated on a regular basis. The “Official Map” cannot be viewed on the Town’s Official Web Page and is extremely difficult to find at the Middlesex North Registry of Deeds. The DHCD does not recognize this map as being valid.

A strong ‘Yes’ vote was, in one individual’s opinion, not louder than the ‘No’ voters behind microphones, as well as sitting in the non-voter section.

We woulda, coulda, shoulda requested a use of yes and no ballots or an actual standing tally by the tellers, but [I] decided not to belabor the matter and draw out a long Town Meeting any further.

To subject property owners in ancient sub-divisions where ways were laid out over 100 years ago and exempt from sub-division control (via MGL c. 41, s.81FF) is not legal. The Courts will be petitioned to declare the “OFFICIAL MAP” not in compliance with MGL c. 41, s.81E.
